EVENING. CHAIR CALLS TO ORDER THE PUBLIC HEARING FOR RESOLUTION ZERO 1525 THROUGH RESOLUTION 033 25. TONIGHT, COUNCIL, IT'S OUR PLEASURE TO WELCOME JEN WILSON, CAITLIN LEE AND BILL AMOS TO PRESENT ON THE AG PRESERVATION PIECES. THANK YOU, COUNCIL PRESIDENT. ALSO WITH US TONIGHT WE HAVE SOME OF OUR LANDOWNERS WHO ARE COMING INTO THE PROGRAM THIS ROUND. SO WE'RE HAPPY TO HAVE THEM WITH US AS WELL. A LOT OF SLIDES, MOSTLY TRYING TO GET SOME PICTURES SO YOU CAN SEE THESE PROPERTIES AND GET A LOOK AT THEM. SINCE MOST OF US WON'T EVER GET A CHANCE TO ENJOY THEM. SO I'LL TRY TO BREEZE THROUGH THEM. BUT FOR THE MOST PART, I REALLY WANT TO SHOW YOU THOSE PICTURES. WE ALWAYS START WITH WHY DO WE PRESERVE? AND THE OVERARCHING IDEA IS THAT LAND PRESERVATION IS A MASTER LAND USE PLANNING TOOL. SO WE ARE LOOKING TO OUR MASTER PLAN TO SEE HOW WE WANT TO DEVELOP THE COUNTY. AND LAND PRESERVATION IS ONE OF THOSE TOOLS THAT WE USE TO GUIDE THE COUNTY FORWARD INTO THE FUTURE. OUR PRESERVATION GOAL WAS LAST SET IN OUR 2016 MASTER PLAN OF 75,000 ACRES BY 2040. RIGHT NOW, WE'RE AT 66,000 ACRES CURRENTLY PRESERVED. SO THAT'S PRIVATE LAND THAT IS PRESERVED. THAT DOESN'T COUNT PARKS. AS WE MOVE INTO OUR NEXT MASTER PLAN UPDATE IN THE NEXT COUPLE YEARS, WE MAY WANT TO CONSIDER UPDATING OUR GOAL TO MEET THE STATE'S, WHICH IS 30% BY 2030, 40% BY 2040. SO THOSE WOULD THEN INCLUDE PARKLAND. BUT THAT'S SOMETHING TO CONSIDER AS WE MOVE FORWARD. AND THEN ALSO WHY WE DO LAND PRESERVATION TO BENEFIT THE ENTIRE COUNTY. SO LANDOWNERS ARE GETTING EQUITY FROM THIS PROGRAM OUT OF THEIR LAND WITHOUT SELLING FOR DEVELOPMENT. THE COUNTY ALSO HAS A CHANCE TO PUT A PERMANENT LIMIT IN ON SUBURBAN SPRAWL. WE KNOW ZONING CAN CHANGE. WE JUST WENT THROUGH COMPREHENSIVE REZONING. WE KNOW REGULATIONS AROUND DEVELOPMENT CAN CHANGE, BUT THESE EASEMENTS ARE IN PERPETUITY, SO THEY LAST FOREVER. AND THIS IS ALSO A COST EFFECTIVE WAY TO LIMIT THAT GROWING NEED FOR SERVICES LIKE FIRE, EMS, SCHOOLS, WATER AND SEWER, ALL OF THOSE THINGS. IT'S ALSO HOPING TO PROTECT AGRICULTURAL LAND SO THAT WE CAN HAVE A LOCAL SUPPLY OF FOOD AND FIBER INTO THE FUTURE. I ALWAYS LIKE SHOWING THE CHART WITH THE TIMELINE. SINCE WE STARTED PRESERVATION, WE USE A VARIETY OF PROGRAMS AND WE'VE ADDED SEVERAL THROUGHOUT THE YEARS USING BOTH LOCAL, STATE, AND EVEN FEDERAL MONEY. THE BARS INDICATE HOW MUCH LAND HAS BEEN USED BY EACH PROGRAM, HOW MUCH IS PRESERVED, AND YOU CAN SEE THE PURPLE IS OUR COUNTY PROGRAM. BY FAR, THIS IS OUR MOST SUCCESSFUL PROGRAM IN TERMS OF ACRES. WELL OVER HALF OF OUR 66,000 ACRES HAS BEEN PRESERVED USING THE COUNTY PROGRAM. AND THEN ALSO THIS PROGRAM IS VERY DETAILED AND A BIT COMPLICATED, HAS A LOT OF MATH INVOLVED, AND WE DON'T WANT THERE TO BE ANY HUMAN BIAS OR CALCULATION ERRORS. SO SEVERAL YEARS AGO, ONE OF OUR NOW RETIRED PLANNING AND ZONING STAFF, MR. BRUCE JOHNSON, CREATED WHAT WE CALL ALVIN. IT'S AN AUTOMATED PROGRAM THAT WE USE TO DO MEASUREMENTS AND CALCULATIONS ON THESE PROPERTIES DOCUMENTS THE WHOLE PROCESS A LOT FASTER AND A LOT MORE ACCURATE THAN ME WITH PENCIL AND PAPER. WE GO THROUGH EACH APPLICATION WITH OUR RANKING, AND THIS IS ALL PART OF THE COUNTY CODE THAT WE UPDATED LAST YEAR WITH OUR RANKING CRITERIA. WE'RE LOOKING AT THINGS LIKE THE SIZE OF THE PROPERTY, THE QUALITY OF THE SOIL, AND EVEN THE QUALITY OF THE NATURAL RESOURCES ON SITE.

THINGS LIKE THE HABITAT OR MAJOR STREAMS THAT MIGHT BE ON OR NEAR THE PROPERTY. AND THEN THERE'S A WHOLE LOT OF MATH FOR EACH ONE. I'VE INCLUDED THE DETAILS OF HOW EACH PROPERTY COMING BEFORE YOU TONIGHT, HOW IT RANKED. THEN WE ALSO LOOK AT THE VALUE OF THE EASEMENT. THIS IS A BIT MORE COMPLICATED. WE DO THREE CALCULATIONS FOR EACH PROPERTY. IT'S ALWAYS THE LOWEST VALUE IS WHAT THE OFFER IS TO THE LANDOWNERS. IT'S BASED ON FIRST A FORMULA WHERE WE TAKE A POINT SYSTEM LOOKING AGAIN SIZE DEVELOPMENT RIGHTS, QUALITY OF THE SOILS. AND WE CONVERT THAT INTO A DOLLAR VALUE. AND THEN WE HAVE TWO MAXIMUMS IN PLACE CAP VALUES.

SO WE DON'T HAVE RUNAWAY NUMBERS. SO WE HAVE A MAXIMUM PER ACRE AND A MAXIMUM BASED ON THE LOTS THAT COULD BE CREATED. SO AGAIN IT'S ALWAYS THE LOWEST OF THOSE THREE. AND THEN LAST YEAR IN OUR UPDATE WE REDESIGNED OUR INCENTIVE AREAS OR WHAT WE CALL THE BONUS AREAS.

THESE ARE BASED ON WHERE THE PROPERTY IS WITHIN THE COUNTY. SO WE'RE LOOKING AT PROPERTIES IN THE DEVELOPMENT ENVELOPE. HAVING HIGHER REAL ESTATE VALUES. MAYBE THE PROPERTIES WITHIN THAT ONE MILE BUFFER BEING MORE AT RISK FOR CONVERSION. SO THOSE WE WANT TO ENCOURAGE TO CHOOSE PRESERVATION INSTEAD OF BEING CONVERTED INTO DEVELOPMENT. AND WE HAVE TWO OTHER AREAS. AGAIN THE AREA SEE KIND OF BASED ON BEING SOUTH OF THE PROPERTY PRESERVATION AREA. SO JARRETTSVILLE FALLSTON, CHURCHVILLE, CRESWELL, THOSE AREAS AND OUTSIDE OF JOPPA. AND THERE'S A LITTLE POCKET THERE OF THAT AREA. AND THEN OUR FOURTH ONE IS BASED ON ZONING. SO IF THE PROPERTY IS NOT ZONED AGRICULTURAL OR IF IT'S NEXT TO SOMETHING THAT'S NOT ZONED AGRICULTURAL, SO THINGS LIKE THE RR ZONING THAT'S IN BOSTON, THOSE PROPERTIES WOULD RECEIVE A BONUS PAYMENT. AND AGAIN, OUR EVALUATION SHEET THAT'S CREATED THROUGH ALVIN DOING ALL THE CALCULATIONS, FIGURING OUT WHICH ONE IS THE LOWEST AND ADDING IN THE FINAL BONUS PAYMENT. AND THEN THE LAST DECISION FOR OUR LANDOWNERS IS HOW THEY WOULD LIKE TO BE PAID. WE HAVE TWO OPTIONS NOW AVAILABLE. IT'S EITHER A LUMP SUM PAYMENT, WHICH IS ALL RECEIVED BY THE OWNER SETTLEMENT. THAT'S WHAT IS BEFORE YOU ALL 19. THEY CAME TO YOU AS RESOLUTIONS BECAUSE THEY ARE LUMP SUM PAYMENTS. OUR OTHER OPTION IS AN INSTALLMENT PAYMENT THAT'S PAID OUT OVER THE YEARS. THAT WOULD HAVE COME OVER HERE AS A BILL INSTEAD OF A RESOLUTION. AND THEN ALL OF THE MATH. WITH ALL WITH THE VALUATIONS THROUGH THE THREE CALCULATIONS. AND WHAT WE'RE MOST EXCITED ABOUT THIS YEAR IS HOW FAR AND WIDE OUR EASEMENTS ARE SPREAD. WE'VE GOT THINGS. WE'VE GOT EASEMENTS COMING IN AT THE MASON-DIXON LINE. WE'VE GOT EASEMENTS COMING IN IN JOPPA, IN ABERDEEN, IN BEL AIR, ALL ACROSS THE COUNTY. SO WE'RE VERY EXCITED TO SEE THAT. SO ON THE MAP, THEY ARE THE RED HIGHLIGHTED ONES. THE OTHER PROPERTIES THAT ARE HIGHLIGHTED THERE ARE ALREADY PRESERVED PROPERTIES. AND SO I'M GOING TO GO THROUGH EACH PROPERTY. AND THEN THE KEY TO REMEMBER THIS HAS DOLLAR AMOUNTS IN IT. THE RESOLUTIONS HAVE DOLLAR AMOUNTS THAT WE GIVE A 10% CUSHION TO.

IN CASE ONCE THE LANDOWNERS DO THE SURVEYS THEY COME BACK WITH MORE LAND. WE DON'T WANT TO BE BACK OVER HERE IN A MONTH OR TWO BECAUSE WE UNDERESTIMATED HOW MUCH MONEY WE NEEDED. SO THERE IS A CUSHION TO THOSE PRICES AND THOSE NUMBERS IN THE RESOLUTIONS. BUT THESE ARE THE NUMBERS THAT THE LANDOWNER SAW. SO UP FIRST IS THE BAUER PROPERTY. THIS IS IN FOREST HILL, KIND OF BETWEEN ROCK SPRING AND JARRETTSVILLE ON EAST WEST HIGHWAY THERE, AND 57 ACRES FOR DEVELOPMENT RIGHTS. BEAUTIFUL PROPERTY THAT YOU WOULD NEVER KNOW HOW GORGEOUS IT WAS UNTIL YOU DROVE BACK THEIR DRIVEWAY. THIS ONE IS ELIGIBLE FOR TWO DIFFERENT BONUS AREAS. THEY ONLY GET CREDIT FOR ONE. AND WE'RE VERY EXCITED THAT THE BERKHEIMER FAMILY HAS CHOSEN TO MOVE INTO A PERMANENT PRESERVATION EASEMENT. THIS IS 113 ACRES WITH TEN DEVELOPMENT RIGHTS. AND AGAIN, RIGHT ON THE DOORSTEP OF THE CITY OF ABERDEEN. SO IT'S A BEAUTIFUL FARM AND WE'RE VERY HAPPY TO SEE IT COME IN AGAIN. IT'S IN THAT MOST AT RISK ONE MILE BUFFER AREA WITH THE BONUS AREA.

UP. NEXT WE HEAD TOWARDS WHITEFORD WITH WENDY BURNS AND STEVEN GRAYBILL. THIS IS A 20 ACRE PROPERTY WITH ONE EXTRA DEVELOPMENT RIGHT ON COOPER ROAD. THIS IS A PROPERTY WITH A LOT OF NATURAL RESOURCES, AND THEY'RE WORKING ON INCREASING THE FOREST AND PROVIDING SOME GREAT HABITAT AND NATURAL RESOURCE OUT THERE. SO WE'RE REALLY HAPPY TO PRESERVE SOME LAND ADJACENT TO THAT STATE FOREST AND PROVIDE SOME PROTECTION TO THAT 39 ACRES WITH TWO EXTRA DEVELOPMENT RIGHTS. IT'S A BEAUTIFUL FLOWER FARM. AND AGAIN, DEVELOPMENT.

AND NEXT THIS IS IN THE JOPPA AREA, DISTRICT B, THE NIELSEN FARM. THIS IS A LOVELY HORSE FARM, 38 ACRES TWO DEVELOPMENT RIGHTS AND BEAUTIFUL PROPERTY THAT WE'RE HAPPY TO SEE COME IN. AND IT'S ON CLAYTON ROAD. IT'S A BEAUTIFUL, MORE RURAL AREA THAT EVERYBODY KIND OF FORGETS ABOUT AS BEING RURAL. THEY'RE LOOKING AT 12% IS WHAT WAS HAPPENING. THEY WANT TO INCREASE IT TO 25%. ANY RUNOFF OR DISCHARGE ENTERING THE BALTIMORE GUN, ENTERING THE GUNPOWDER IN BALTIMORE COUNTY ACTUALLY FLOWS DOWNSTREAM DIRECTLY INTO HARFORD COUNTY'S TIDAL WATERS, IMPACTING COMMUNITIES SUCH AS JOPPATOWNE, EDGEWOOD, AND OTTER POINT CREEK. THESE ARE AREAS ALREADY VULNERABLE TO FLOODING AND STORM SURGE. WHEN POLLUTANTS ENTER THE SYSTEM, THEY CAN TRAVEL THROUGH THE TIDAL MOVEMENT AND WIND CURRENTS INTO THE BUSH RIVER AND THE UPPER CHESAPEAKE BAY, THREATENING AQUATIC LIFE, RECREATION, AND OUR DRINKING WATER SOURCES. AS WE JUST HAD A STORM WITH HIGH WINDS AND RAIN LAST WEEK. THIS IS A GOOD EXAMPLE OF HOW THIS TRASH JUICE WOULD BE CIRCULATED THROUGH AND INTO OUR WATERS. THIS IS NOT JUST AN ENVIRONMENTAL ISSUE, IT'S A PUBLIC HEALTH ISSUE. AND HARFORD COUNTY RESIDENTS DESERVE ASSURANCE THAT WHAT HAPPENS UPSTREAM WILL NOT ENDANGER THEIR HOMES, THEIR WATER OR THEIR FUTURE. DAVE'S COVE HAD HAD REPEATED VIOLATIONS SINCE 2023 AND MDE, ALTHOUGH THEY'VE NOTED THESE VIOLATIONS, IS STILL LOOKING AT THE POSSIBILITY OF PERMITTING THEM TO HAVE THE PERMIT. THE BALTIMORE COUNTY COUNCIL HAS ALREADY ENACTED UNANIMOUSLY TO OPPOSE THIS PERMIT, AND I BELIEVE HARFORD COUNTY SHOULD STAND WITH THEM. OUR MESSAGE TO THE MARYLAND DEPARTMENT OF ENVIRONMENT MUST BE CLEAR. WE SUPPORT STRONGER ENVIRONMENTAL PROTECTIONS, INDEPENDENT REVIEW AND ACCOUNTABILITY FOR ANY OPERATION THAT IMPACTS OUR SHARED WATERWAYS. SO HAD A LOT OF FUN MAKING A VIDEO, HAD A LOT OF FUN BEING THERE DRESSED AS JAKE ELWOOD, AND IT'S ALWAYS GREAT.

AND ALSO, MY CONDOLENCES AGAIN TO MARY HASLER. SHE HAD FALLEN AFTER UNFORTUNATE WITH HER HER HUSBAND AND SHE WAS ABLE TO BE THERE. SO I WAS GLAD TO SEE MARY THAT DAY. COUNCIL PRESIDENT VINCENTE AND MY OTHER COUNCIL MATE JIM RILEY WAS THERE AS WELL. OKAY. AND SO THE VETERANS RESOURCE FAIR IS, COUNCILWOMAN IMHOFF SAID, IS FRIDAY, NOVEMBER 15TH AT THE BEL AIR ARMORY. THEY'RE GOING TO HAVE FOOD FROM MISSION BARBECUE PROVIDED BY HARFORD COUNTY GOVERNMENT. WE WERE OUT LAST SATURDAY AT THE FARMERS MARKET, TRYING TO MAKE SURE PEOPLE KNEW ABOUT THE VETERANS FAIR, AND I'LL BE THERE AGAIN THIS SATURDAY WITH A TABLE SET UP. I'M HOPING WITH THE VETERANS FAIR. THIS PAST FRIDAY, 150 PEOPLE CAME TO OUR CUPBOARD LOOKING FOR GROCERIES FOR THE WEEK. 30 OF THOSE PEOPLE HAD NEVER COME BEFORE. THINGS ARE REALLY TOUGH FOR PEOPLE RIGHT NOW FOR FOOD. YOU KNOW, IN MY DAY JOB, I WENT ON A FIELD TRIP AND WE HAD SEVERAL FAMILIES NOT COME BECAUSE THEY SAID, WE CAN'T SPEND $19 ON A FIELD TRIP RIGHT NOW. WE NEED THAT MONEY FOR FOOD. AND SO I JUST ENCOURAGE EVERYBODY WHO'S ABLE TO GIVE TO SUPPORT OUR LOCAL FOOD PANTRIES, WHICHEVER ONE IS, YOU KNOW, CLOSEST TO YOU OR MOST MEANINGFUL TO YOU. THEY ALL NEED THE SUPPORT RIGHT NOW, EVEN WITHOUT EVERYTHING GOING ON WITH THE FEDERAL GOVERNMENT. THINGS HAVE BEEN REALLY TOUGH THIS YEAR FOR PEOPLE. SO JUST KEEP THOSE PEOPLE IN MIND.
